Testamentary versus Inter Vivos Trusts

An “inter vivos” Trust is a Trust you create while you are alive. A Testamentary Trust is a Trust created under your Last Will and Testament. An inter vivos Trust can often function entirely outside the province of the Surrogate’s Court. A Testamentary Trust, being part of a Will, must pass muster with the Surrogate’s Court. A Testamentary Trust is managed under the supervision of the Court, which may or may not suit your purposes.
